General Terms of Sale

Commercial terms governing subscription purchases.

Last updated: 2026-07-22

1. Scope

These General Terms of Sale ("GTS") apply to all purchases of subscription plans for the Black Cat Security SaaS Security Posture Management platform. By placing an order, you accept these GTS in full. These GTS supplement and are to be read in conjunction with our Terms of Service.

2. Pre-Contractual Information

In accordance with Articles L221-5 and L221-11 of the French Consumer Code (Code de la consommation), the essential characteristics of the services, their price, and all relevant contractual information are provided to you before any order is placed. This information is available on our website and in these GTS, ensuring you can make an informed decision.

3. Products and Services

The services offered consist of subscription plans to the Black Cat Security SSPM platform. Each plan provides access to specific features, usage limits, and support levels as described on our pricing page. The precise features included in each plan are detailed at the time of purchase and may evolve over time with reasonable notice.

The Service is a security monitoring and assessment tool. It guarantees neither the detection of all vulnerabilities or misconfigurations, nor the absence of security incidents, nor the Customer's compliance with any law, regulation, or standard. The compliance frameworks, scores, and reports it provides are informational and do not constitute legal, audit, or professional advice. The Customer remains solely responsible for the security of its systems and for its own regulatory compliance.

4. Pricing

Prices are displayed on the website in euros (EUR). A US-dollar (USD) payment option is available at checkout. Black Cat Security applies the French VAT-exemption regime for small businesses (franchise en base de TVA): pursuant to Article 293 B of the General Tax Code (Code général des impôts), no VAT is charged and invoices bear the statement « TVA non applicable, art. 293 B du CGI ». The price displayed is therefore the total amount payable. Prices are subject to change; however, any price change will be communicated at least 30 days in advance and will only apply to new subscription periods.

Black Cat Security is the seller and contracting party. Payments are processed by card through Stripe, acting as our payment processor on our behalf. For business customers established in another EU Member State who provide a valid intra-EU VAT identification number, VAT is not charged by Black Cat Security and is instead accounted for by the customer under the reverse-charge mechanism (autoliquidation) pursuant to Article 196 of Directive 2006/112/EC. Invoices are issued by Black Cat Security through its certified invoicing platform (Qonto).

5. Ordering Process

Orders are placed through the Black Cat Security website. The ordering process involves selecting a subscription plan, providing the required account information, and completing payment through Stripe's secure, Stripe-hosted checkout. An order confirmation will be sent to you by email upon successful payment. The contract is formed at the moment payment is confirmed.

6. Payment

Payments are processed by card through Stripe on behalf of Black Cat Security. Card data is entered on Stripe-hosted pages and never transits or is stored on our servers. Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected) and renew automatically at the end of each billing period unless cancelled before the renewal date. If a payment fails, we retry collection over a grace period during which your access is maintained; if payment still cannot be collected, the subscription is cancelled. You can change or cancel your plan at any time from your account; payment methods and invoice history are managed through the Stripe billing portal.

For consumer subscriptions subject to French law, in accordance with Article L215-1 of the Consumer Code (Loi Chatel), we will notify you in writing between three months and one month before each tacit renewal date, informing you of your option not to renew. If this notice is not sent within the required timeframe, you may terminate the renewed contract free of charge at any time after the renewal date, and any sums paid after that date that do not correspond to actual use of the Service will be reimbursed within 30 days.

7. Right of Withdrawal

In accordance with the EU Consumer Rights Directive (Directive 2011/83/EU) and Articles L221-18 to L221-28 of the French Consumer Code, consumer customers have a 14-day right of withdrawal (droit de rétractation) from the date of purchase, without needing to provide a reason.

However, if you have given your explicit prior consent to the immediate provision of the digital service and have expressly acknowledged that you thereby waive your right of withdrawal, the right of withdrawal may be waived in accordance with Article L221-28 of the Consumer Code. If you exercise your right of withdrawal after having begun using the service, you will be charged a proportionate amount corresponding to the service provided up to the date of withdrawal.

8. Refund Policy

9. Delivery

As a digital service, the Black Cat Security platform is made available immediately upon successful payment and account activation. No physical delivery is required. Access credentials are provided to you by email or through the platform's registration process.

11. Liability

12. Consumer Mediation

In accordance with Articles L612-1 and following of the French Consumer Code, in the event of a dispute that cannot be resolved directly with Black Cat Security, consumer customers are entitled to refer the matter, free of charge, to a consumer mediator. Our designated mediator is:

Mediateur

[MEDIATOR_ADDRESS]

13. Applicable Law and Jurisdiction

These GTS are governed by French law. For professional customers, any disputes shall be submitted to the exclusive jurisdiction of the courts of Paris, France. For consumer customers, disputes shall be submitted to the courts of the consumer's domicile, in accordance with mandatory consumer protection rules.
